Uber Technologies Inc. (NYSE:UBER) and LYFT Inc. (NASDAQ: LYFT) prospects and future in California hang in the balance. A court has ruled that the two ride-sharing services must comply with a preliminary injunction requiring them to stop classifying drivers as independent contractors. The two companies are against classifying drivers as employees as they will be forced to pay them benefits and provide other perks, as is the case with other employees.
Uber & Lyft California Stalemate
In its ruling, the appeals court concluded that the trial judge acted within his discretion to issue the preliminary injunction. However, the order won't come into effect right away. Uber and Lyft have about 60-days to ask the California Supreme court to resend the order. The reprieve will lift 30 days after the case is sent to the trial court.
While the two can heave a sigh of relief, there prospects still hang in the balance. An upcoming ballot measure could help reinvigorate the companies’ fate in the state. Proposition 22, if approved by voters, would exempt app-based ride and delivery services from the Labor Law, which is the bone of contention.
Uber and Lyft have already reiterated that it is impossible to classify drivers as employees as it will affect their business's core nature. If pushed further, the two have warned they will have no option but temporarily suspend services in the state.
Proposition 22 Hopes
Lyft Spokesperson, in a statement, reiterated that the ruling makes it more urgent for voters to stand up with drivers. Should voters turn down Proposition 22, thousands of jobs would be at risk on Uber and Lyft shutting down operations in the state.
Uber, on its part, is considering all the legal options given the high stakes. Drivers on their part have shown support to Proposition 22, given that their jobs are at risk at a time when millions of people have been rendered jobless owing to the covid-19 shocks. The U.S economy is struggling with its biggest contraction in recent history, more than one million people having filed for unemployment benefits.
