It is barely one week after Tesla Inc (NASDAQ:TSLA) hosted its 2020 Battery Day conference and the company is already hitting hard at its trucking rival Nikola Corporation (NASDAQ:NKLA).
Nikola filed a lawsuit against Tesla two years ago accusing the EV manufacturer of copying its truck design. Nikola sought $2 billion in damages from Tesla in the lawsuit. However, Tesla recently submitted its response in the case, claiming that Nikola stole the design for the truck from a designer known as Adriano Mudri who is the design director at Rimac.
"Road Runner concept truck was entered into the 2010 Michelin Design Challenge, and was selected for display at the 2010 North American International Auto Show," stated Tesla.
Did Tesla really copy the design from Nikola?
Nikola could still technically win the lawsuit if it can prove its ownership of the patent rights to the truck designed by Mr. Mudri. It does claim to have acquired the patents, but Tesla’s counter-argument is that Nikola failed to reveal that some of the design features of the Nikola One truck came from Mudri. Nikola acquired the patent in 2016 and Tesla unveiled its semi-truck a year later.
Tesla claims that Trevor Milton, the founder of Nikola met with Mudri about 5 or 6 years ago and afterward applied for a patent for Mudri’s design. However, he did not include Mudri as the designer in the patent, which might indicate an intent to use the patent for trolling purposes. Tesla believes that failure to acknowledge the original designer invalidates the patent, which means that the Nikola founder stole the design.
If the claims that Nikola also stole the patent turns out to be true, then it will add to the company’s growing list of problems while validating Tesla’s lead. Just a few days ago, Nikola faced a lot of backlash for reportedly using false tactics to market its semi-truck. The truck was rolling down a hill in a promotional video from 2016 suggesting that it was not fully functional. The company may have developed the motors and fuel cell technology since then but it did come clean that the truck was not fully functional and this let to a huge short on its stock.
