It’s battle-royale in the corridors of justice. Amazon Web Service has hit back over breach of contract claims by under-fire social media platform Parler. Through its attorney, Amazon.com, Inc. (NASDAQ:AMZN)’s cloud computing unit maintains Parler lawsuit is baseless and meritless.
Amazon vs. Parler
Through its attorney, Amazon Web Service argues that it is Parler that breached the terms of the contract on doing little to curb the proliferation of inciting messages and posts on the platform. According to AWS, Parler in action allowed people to continue posting content that threatened public safety.
The defense comes in the wake of Amazon reiterating that it has shared dozens of examples with Parler that showed the platform was being used to incite and plan violence against public officials and private citizens.
According to Amazon, some of the high profile personality targeted by Parler users include its CEO Jeff Bezos, Facebook, and Twitter CEOs Mark Zuckerberg and Jack Dorsey. Former Transportation Secretary, Elaine Chao, has also not been spared.
Amazon Defense
Amazon has also refuted claims that it interfered with Parler’s relationship with its users, reiterating that its claims do not meet the minimum threshold under the Sherman Act claim. Parler has in the recent past alleged that Amazon's move to end offering web hosting support amount to an antitrust violation on getting rid of the competition.
In its defense, Amazon has invoked the same law that President Donald Trump has always used to malign tech giants. According to the tech giant, Section 230 of the constitution offers sufficient immunity against claims that the moderation efforts are being used to eliminate Parler.
The litigation is already building up to be a high-profile test amidst claims that tech giants are going overboard with their policing efforts. While some people have called tech giants to do more some, have argued that delisting platforms and banning some people amount to infringement of freedom of speech and expression.
